Rights and reproductions

The Marc Chagall Estate holds the exclusive right to grant to third parties an exploitation right over the artist's works, including the right of reproduction and/or representation within the meaning of the provisions of Book III of the French Intellectual Property Code, as well as over the artist's personality rights and trademarks.

The Marc Chagall Estate has entrusted the ADAGP – an organization of authors in the graphic and plastic arts – with managing the artist's copyright for France and the rest of the world. Thus, any request for exploitation of the artist's works must be sent directly to ADAGP for prior approval. Any unauthorized use constitutes a copyright infringement.

La Succession Marc Chagall détient le droit exclusif de concéder aux tiers un droit d’exploitation sur les œuvres de l’artiste en ce compris le droit de reproduction et/ou de représentation au sens des dispositions du Livre III du Code de la propriété intellectuelle, ainsi que sur les droits de la personnalité de l’artiste et les marques.  

La Succession Marc Chagall a confié un mandat de gestion des droits d’auteur de l’artiste à l’ADAGP – société des auteurs dans les arts graphiques et plastiques – pour la France et le reste du monde. Ainsi, toute demande d’exploitation relative aux œuvres de l’artiste doit être transmise directement à l’ADAGP pour accord préalable. Tout usage non autorisé est constitutif d’un délit de contrefaçon.

REPRODUCTION AUTHORIZATION

On the ADAGP website, fill in the authorization request form
Send the mock-up of the document (pdf format including images and texts) as well as the page(s) mentioning the copyrights and obtain approval from the Marc Chagall Estate.
Receive HD files and then destroy them after using them for the purpose for which you obtained these permissions.

COMMITMENTS TO BE OBSERVED

All reproductions of works by Marc Chagall must be subject to a prior written request. The terms for reproducing the work shall be formalized in writing, provided that it will contain, at least, the following commitments:

The work reproduced may not be cut or cropped in any way, unless prior approval has been obtained and a reference (detail) has been included in the work's description.
The work must be reproduced in its original color.
All reproductions must be accompanied, near or in a detailed list, by the illustrations reproduced, as well as the following caption and copyright notice.

Note: ADAGP does not assign the photographer's rights. The author or the right-holders of the photo will have to be contacted in order to obtain their authorization. The Marc Chagall Estate declines all responsibility for the use of images that have not been duly authorized in accordance with current laws on intellectual property.
